Land purchase for veterans, citizens cemetery passes

OKMULGEE, Oklahoma — A quarterly session of the Muscogee (Creek) Nation National Council was held July 29 at the Mound Building in Okmulgee.

Council addressed the following legislation, which was addressed as follows:

TR 17-085 Authorizing the adoption of policies and procedures for MCN Contracting and Employment Support Office. Rep. David Hill sponsored the resolution, which passed 14-0.

TR 17-090 Authorizing the principal chief to execute a professional medical services contract for specialty care with the Citizen Potawatomi Nation (Potawatomi Optometry) on behalf of MCN Department of Health. Rep. Dode Barnett sponsored the resolution, which passed 14-0.

TR 17-091 Authorizing the principal chief to execute a transfer agreement among the Indian Health Service on behalf of the U.S. and the Vivian Rural Water District No. 6. Rep. Del Beaver sponsored the resolution, which passed 14-0.

TR 17-092 Authorizing the principal chief to execute a memorandum of agreement between the IHS, MCN and City of Henryetta for community water system improvements for Indian-owned homes in Okmulgee County. Del Beaver sponsored the resolution, which 14-0.

TR 17-093 Authorizing the construction of a farmhouse at the Dustin Ranch and the Hanna Farm. Rep. Mark Randolph sponsored the resolution, which was postponed for two months with a vote of 14-0.

TR 17-094 Authorizing the principal chief to execute an amendment No. 1 to the memorandum of agreement between MCN and IHS for the construction of individual on-site sewer systems in McIntosh County. Del Beaver sponsored the resolution, which passed 14-0.

TR 17-096 Authorizing the principal chief to execute a U.S. Department of Interior Bureau of Indian Affairs oil and gas mining lease on tribal property located in Hughes County. Rep. Thomas Yahola sponsored the resolution, which passed 14-0.

TR 17-097 Approving the memorandum of agreement for IHS Project OK 08-Q28, approving the exchange letter amendment part II and authorizing the principal chief to execute a transfer agreement among IHS on behalf of the U.S. and the Okmulgee County Rural Water District No. 2. Randolph sponsored the resolution, which passed 14-0.

TR 17-098 Approving the memorandum of agreement fir IHS Project OK 08-D41, exchange letter amendment part II, exchange letter amendment part II and authorizing the principal chief to execute a transfer agreement among IHS on behalf of the U.S., the Okmulgee County Rural Water District No. 2 and the City of Eufaula. Randolph sponsored the resolution, which passed 14-0.

TR 17-100 Authorizing the principal chief to execute a memorandum of agreement between the IHS and MCN. Randolph sponsored the resolution, which 14-0.

TR 17-101 Authorizing the principal chief to execute an easement across tribal land for the construction and maintenance of a sanitary sewer line for the new Eufaula Indian Health Clinic. Rep. Darrell Proctor sponsored the resolution, which passed 14-0.

TR 17-103 Authorizing the principal chief to execute a repatriation agreement with the National Park Service Ocmulgee National Monument for the transfer of human remains and funerary objects at the Ocmulgee National Monument to MCN. Randolph sponsored the resolution, which passed 14-0.

TR 17-104 Confirming the nomination of Montie Deer to serve as an MCN Supreme Court Justice. Hill sponsored the resolution, which passed 14-0.

TR 17-105 Authorizing membership of the Nation in the Northeast Oklahoma Regional Alliance. Rep. Pete Beaver sponsored the resolution, which passed 14-0.

TR 17-106 Authorizing the principal chief to submit a Native American Business Development Institute Grant Application to the BIA for the development of an economic impact study. Rep. Randall Hicks sponsored the resolution, which passed 14-0.

TR 17-107 Confirming R. Daniel Carter to serve on the Mvskoke Media Editorial Board. Rep. Lucian Tiger sponsored the resolution, which passed 14-0.

TR 17-108 Authorizing the principal chief to execute a contract for the purchase of property located in Okmulgee County, Oklahoma. Del Beaver sponsored the resolution, which passed 14-0.

The property is located at 1900 N. Morton, Okmulgee, OK, west of the Claude Cox Omniplex and is around 39.3 acres. The legislation states the property will be developed for a veterans and tribal cemetery.

The purchase is contingent upon clear title and environmental survey.

Once purchased, the Nation will apply to transfer the property into trust.

MCN Principal Chief James Floyd said during the committee session that 12.5 acres would be used for the tribal veterans cemetery and the remaining for citizens.

TR 17-109 Authorizing the principal chief to execute a contract for the purchase of property located in Okmulgee County, Oklahoma. Rep. James Jennings sponsored the resolution, which passed 14-0.

TR 17-110 Authorizing the Marine Corps Color Guard to display and handle their unloaded rifles during the Marine Corps Ball Ceremony at the River Spirit Casino Resort. Rep. Robert Hufft sponsored the resolution, which passed 14-0.

TR 17-111 Authorizing an MCN Tribal Veterans Cemetery in Okmulgee County, Oklahoma. Del Beaver sponsored the resolution, which passed 14-0.

TR 17-112 Authorizing the execution of an attorney services contract between MCN and Rosette LLP. Hufft sponsored the resolution, which was postponed for one month with a vote of 12-2 with Barnett and Hill voting against it.

The Nation would like to use Rosette for legal matters.

Legislation states Rosette would report to the executive and legislative branches of the Nation.

The ‘Muscogee Nation News’ reached out to Barnett and Hill Aug. 7 regarding their vote, but did not receive a response as of press time.

NCA 17-081 Repealing MCN Code Annotated Title 21, titled, ‘GAMING,’ and creating a new Title 21, titled, ‘GAMING.’ Hufft sponsored the amendment, which passed 11-2-1 with Randolph abstaining and Barnett and Hicks voting against it.

MCNCA Title 21 was repealed and replaced to ensure the Nation’s compliance and consistency with the Indian Gaming Regulatory Act and the National Indian Gaming Commission.

Hicks explained his no vote on the legislation.

“I didn’t support it because I spoke to Buddy York, the gaming commissioner and he wasn’t really quite satisfied with what was presented and he wanted a little bit more time,” Hicks said.

Hicks added that he wanted to give York more time to review the legislation.

NCA 17-105 Amending MCNCA Title 16, sub-section 9-103, sub-section 9-108, sub-section 9-125, sub-section 9-129, and sub-section 9-135, titled, ‘MCN Contracting and Employment Support Act.’ Hill sponsored the amendment, which passed 14-0.

NCA 17-111 Authorizing a $5,000 donation to sponsor the Central Oklahoma American Indian Health Council, Oklahoma City Indian Clinic’s 13th annual Red Feather Gala. Rep. James Jennings sponsored the amendment, which passed 14-0.

NCA 17-112 Authorizing a supplemental appropriation for the MCN Head Start program and expend any additional funds awarded by Health and Human Services Administration. Jennings sponsored the amendment, which passed 14-0.

NCA 17-113 Authorizing a budget modification in excess of ten percent for the MCNDH. Barnett sponsored the amendment, which passed 14-0.

NCA 17-114 Authorizing a $2,000 donation to Depew Public Schools. Hill sponsored the amendment, which passed 14-0.

NCA 17-115 Authorizing a $5,000 donation to the Disabled American Veteran McIntosh County Chapter 3. Rep. Adam Jones III sponsored the amendment, which passed 14-0.

NCA 17-116 Authorizing a supplemental appropriation of $290,900 to the MCN Employment and Training Vocational Tribal and Incentive Grants Program for the FY 2017 budget. Jennings sponsored the amendment, which passed 14-0.

NCA 17-117 Establishing an MCN Family Violence Prevention Program revolving fund. Barnett sponsored the amendment, which passed 14-0.

NCA 17-118 Authorizing a budget modification in excess of ten percent for MCNDH office buildings. Barnett sponsored the amendment, which passed 14-0.

NCA 17-122 Authorizing a $280,815 appropriation to the MCN Head Start Program for the purchase of five, new twenty-nine passenger buses. Tiger and Jones sponsored the amendment, which passed 14-0.

NCA 17-123 Authorizing a budget modification in excess of ten percent for the MCN Elderly Nutrition Program. Barnett sponsored the amendment, which passed 14-0.

NCA 17-124 Authorizing a $1,600 expenditure of funds awarded from the Oklahoma Association to MCNDH. Barnett sponsored the amendment, which was passed 14-0.

NCA 17-125 Authorizing an appropriation of $1,054,928for the construction of a farmhouse at the Dustin Ranch and Hanna Farm. Randolph sponsored the amendment, which was postponed for two months with a vote of 14-0.

NCA 17-126 Amending NCA 12-207 (A law of the MCN authorizing a special appropriation to historical Muscogee Indian churches to assist with providing Christmas to Creek families). Yahola sponsored the amendment, which passed 14-0.

NCA 17-127 Authorizing an appropriation of $200,000 to the MCN Realty Trust Services Department for fee to trust expenses. Tiger sponsored the amendment, which passed 14-0.

NCA 17-128 Amending MCNCA Title 5, Chapter 2 titled, ‘Financial Assistance’ and creating new law in MCNCA Title 5, 2-107 titled, ‘Heating Expense Grant.’ Randolph sponsored the amendment, which passed 14-0.

NCA 17-129 Authorizing the appropriation of $25,000 to provide financial assistance to Muscogee (Creek) traditional churches for church camps. Randolph sponsored the amendment, which passed 14-0.

NCA 17-130 Authorizing the appropriation of $75,000 to provide financial assistance to Muscogee (Creek) traditional churches for lawnmowers. Randolph sponsored the amendment, which was postponed for two months with a vote of 14-0.

NCA 17-131 Authorizing a special appropriation of $4,899.99 to Apehkv Fellowship Church. Jennings sponsored the amendment, which passed 13-1-0 with Hill abstaining.

NCA 17-132 Authorizing a special appropriation of $2,119.98 to Ryal Community Baptist Church. Randolph sponsored the amendment, which 14-0.

NCA 17-133 Authorizing a special appropriation of $4,849 to Concharty United Methodist Church. Randolph sponsored the amendment, which passed 14-0.

NCA 17-134 Authorizing a special appropriation of $1,699 to Covenant Harvest Ministries. Randolph sponsored the amendment, which passed 14-0.

NCA 17-135 Authorizing an amendment to MCNCA Title 28, 7-101, 7-102, 7-103, 7-104 titled, ‘Tribal Construction Engineer.’ Del Beaver sponsored the amendment, which was returned to committee with a vote of 10-4 with Reps. Johnnie Greene, Joyce Deere, Del Beaver and Pete Beaver voting against it.

The legislation amends the position title from MCN Tribal Construction engineer to director of Tribal Construction.

It also grants the individual authority to act as general contractor on behalf of the Nation and select subcontractors for projects through the Nation’s policies and procedures. Self-performed projects are limited to under $500,000 unless the principal chief authorizes otherwise.

Del Beaver explained his no vote on the legislation.

He felt the Council was given an ample amount of time to question and review the legislation.

“By the time Saturday rolled around, I thought that we had ample time to review it and to ask any questions or have any changes that we might need or wanted so that’s why I wasn’t in favor,” Del Beaver said.

NCA 17-136 Authorizing a special appropriation in the amount of $12,500 to a Muscogee (Creek) citizen for education expenses. Hill and Tiger sponsored the amendment, which passed 14-0.

The original amount was $25,000 and was amended on the floor.

The funds will be provided to Muscogee (Creek) citizen George Alexander for his Master of Fine Arts Program at the Studio Arts College International in Florence, Italy.

NCA 17-139 Appropriating $190,000 to be used toward the purchase of real property located in Okmulgee County, Oklahoma. Del Beaver sponsored the amendment, which passed 14-0.

NCA 17-140 Amending MCNCA Title 36, chapter 4, titled, ‘sales tax code.’ Hill sponsored the amendment, which passed 14-0.

NCA 17-141 Authorizing the expenditure of $300,157 awarded from the U.S. Department of Labor to the MCN Reintegration Program. Hill sponsored the amendment, which passed 14-0.

NCA 17-142 Authorizing a $2,125 special appropriation to Many Springs Baptist Church. Rep. Rufus Scott sponsored the amendment, which passed 14-0.

NCA 17-143 Appropriating $285,000 to be used for architectural and engineering fees for the tribal veterans cemetery to be located in Okmulgee County, Oklahoma. Del Beaver sponsored the amendment, which passed 14-0.

Mitch Jack was absent.
